Dakota County Judge Guilty of DWI Gets Probation, Requests Retirement

The Dakota County judge guilty of DWI after registering a .28 blood-alcohol reading has asked the governor to grant him a medical disability retirement. He was sentenced to two years of probation.

Michael Sovis, the Dakota County judge who was pleaded guilty Wednesday to third-degree driving under the influence (DWI) in a Christmas Eve incident, has been sentenced to two years of probation, according to a Pioneer Press article by Emily Gurnon. Sovis also requested that Gov. Mark Dayton grant him a medical disability retirement.  From the article: "He's incredibly remorseful," his attorney, David Ayers, said after Wednesday's hearing. "He was truly devastated by this entire incident, not only because of what he did, which he accepts full responsibility for, but because of the impact that it had on the individuals whose cars were hit, and the whole publicity surrounding this incident caused his friends and family a lot of pain." The Minnesota Department of Public Safety has a new tool when it comes to deterring drunken driving: Twitter. On Friday night, there will be 150 squads patrolling major corridors in the Twin Cities’ largest-ever, one-night, coordinated DWI enforcement effort. But this effort isn’t notable just because of its size; it will also offer Minnesotans the chance to follow along via Twitter. The Department of Public Safety (@MnDPS_OTS) will tweet the age and gender of those arrested for DWI using the hashtag #May10DWI. Too busy to follow along in real time? Dakota County Judge Posts Bond After Being Charged with Christmas Eve DWI

Police say Apple Valley resident Michael V. Sovis had a blood-alcohol level of .28—more than three times the legal limit, according to a report in the Pioneer Press.

Michael Vann Sovis, 63, faces two gross misdemeanor counts of third-degree DWI following the arrest, which took place just before 8 p.m. on Dec. 24 in St. Paul. Sovis, who has served as a judge since 1988, allegedly crashed his Lexus sport-utility vehicle into several parked cars along St. Clair Avenue before driving into a snowbank on the side of the road, according to a criminal complaint cited by the Pioneer Press. Supreme Court Upholds Intoxilyzer Breath-Testing Device's Validity

In a 4-3 ruling, the Minnesota Supreme Court upheld that the Intoxilyzer 5000EN is reliable even though the heavily-debated source code contains errors. What do you think? Is the breath-testing machine reliable?

The Minnesota Supreme Court today upheld that the Intoxilyzer breath-testing machine is reliable, ending a six-year battle in state and federal courts. In a 4-3 ruling, the Supreme Court agreed with District Court Judge Jerome Abrams that the Intoxilyzer 5000EN—a device once used in DWI cases across the state of Minnesota—is reliable even though the heavily-debated source code contains errors. Dissenting from today’s ruling were Supreme Court Justices Alan Page, Paul H. Anderson and Helen Meyer. Wednesday’s ruling means that more than 4,000 DWI and implied-consent cases that have been held up during the appeals process will now proceed. If you get behind the wheel, after having more than one drink, you run MORE of a risk of hurting someone (including yourself) than if you got behind the wheel without that second or third drink....this is proven by studies.
