Kazmierczak pleaded guilty days after the crash to having a blood alcohol concentration higher than .08 but lower than .10 when the crash occurred, which is not a criminal charge in Wisconsin, but is punishable through a fine.
Out of Johnson’s 60-day jail sentence, 40 days were staid. The remainder will be served in 10-day increments each year of his probation. Johnson was assigned 40 hours of community service and must maintain absolute sobriety, among other conditions of his probation. His license will be revoked for six months, and Johnson will undergo an alcohol assessment and treatment, if assigned.
